Description:

The current regulatory, social and political climate automatically clouds a mining project with controversy and it is highly likely that a legal challenge or PR issue will arise. Teamwork and communication between counsel, project managers, PR people and technical consultants from inception of a project is paramount to ensure preparedness for challenges down the line. A lawyer is an important part of the project team and can jointly anticipate and work towards minimizing potential negative reactions and actions by important audiences. Attorneys should be involved in the team from inception, to anticipate and (hopefully) head off problems before they arise, as opposed to the more typical use of lawyers only AFTER there is a problem. Taking this approach, at a minimum, gives clients/companies greater piece of mind and can better position the team to respond and eliminate easy avenues for a challenge. In addition, if and when a challenge does arise (legal in nature or otherwise), the response is much more effective. No one is scrambling around trying to figure out what to say and do, because we've already thought it through together, as a legal/technical/project and PR team jointly advising and overseeing a project.
